The Site is operated by Happy Software Sport Organizer DMCC (License Number DMCC-790107 and their affiliates (referred to herein as “Happy Software” "we", "us", or "our"). PLEASE READ THESE TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS SITE. By using this site, you signify your agreement to these Terms of Use. If you do not agree to these terms of use please do not use the site. We reserve the right, at our discretion, to change, modify, add, or remove portions of these terms at any time. Please check these terms periodically for changes. Your continued use of this site following the posting of changes to these terms will mean you accept those changes.

2. World Amateur Match Race TEAM MEMBERS

To participate in the World Amateur Match Race, the team must register a Team membership

Each team consists of two players, can be men, women or mix. Official handicap (36.0) is required for participation. Both players in a team must be at least 18 years old before the competition starts.

When registering for a team membership, the team captain must be over 18 years of age at registration. The team also needs to pay the participation fee before the start of the competition.

The player or team loses this member status:

- At the end of the calendar year

- If the team withdraws voluntarily

- If their golf association cancels or cancels their membership due to non-compliance with the golf rules,

- If the World Amateur Match Race Committee decides to terminate its membership due to inappropriate behavior during the competition year.

- If the team does not pay its membership.

- If the team breaks any rules in www.locallegendsgolf.com/rules which is entirely decided by the World Amateur Match Race Committee.

3. Billing membership fee

There is no commitment and no automatic renewal.

4. Refunds membership fee

You can request a full refund within 14 days from the day of payment if the tournament has not started by submitting a request at info@locallegendsgolf.com. Once the tournament has started you will only be refunded if there were not enough teams in your local area to start a race. Refunds will be provided in the same way that the initial payment was made (e.g. credit card payments will be refunded directly to the same credit card).

5. Your Account

In the course of registering for or using the Services, you may be required to provide us with certain information, including your name, contact information, username and password (“Credentials”). We handle such information with the utmost attention, care and security. Nonetheless, you, not we, shall be responsible for maintaining and protecting your Credentials in connection with the Services.

If your contact information or other information relating to your account changes, you must notify us promptly and keep such information current. You are solely responsible for any activity using your Credentials, whether or not you authorized that activity. You should immediately notify us of any unauthorized use of your Credentials or if your email or password has been hacked or stolen. If you discover that someone is using your Credentials without your consent, or you discover any other breach of security, you agree to notify us immediately.

You agree that we may use your name and/or logo in reference material such as a user/customer list published on the website.

6. License and Restrictions on Use

We give you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the software provided to you as part of the Services.

You may not (and you may not permit anyone else to): (i) copy, modify, create a derivative work of, reverse engineer, decompile or otherwise attempt to extract the source code of the Services or any part thereof, unless this is expressly permitted or required by law, or unless you have been specifically told that you may do so by us, in writing (e.g., through an open source software license); or (ii) attempt to disable or circumvent any security mechanisms used by the Services or any applications running on the Serv

7. Release / image rights and reproduction rights

By participating in World Amateur Match Race, players allow us to display their name and picture on communication media (website, social media, brochure). If a player wants to maintain his privacy, he must notify the tour that he does not want to show up or give limited access only to members of locallegendsgolf.com.

8. Privacy Policies

These Services are provided in accordance with our Privacy Policy, which can be found at Privacy Policy. You agree to the use of your User Content and personal information in accordance with these Terms and our Privacy Policy.

9. FORUMS AND PUBLIC COMMUNICATION

"Forum" means a chat area, message board, or e-mail function offered as part of this site. If you participate in any Forum within the Site, you must not:

defame, abuse, harass or threaten others;

make any bigoted, hateful or racially offensive statements;

advocate illegal activity or discuss illegal activities with the intent to commit them;

post or distribute any material that infringes and/or violates any right of a third party or any law;

post or distribute any vulgar, obscene, discourteous or indecent language or images;

advertise or sell to, or solicit others;

use the Forum for commercial purposes of any kind;

Therefore, in addition to the privacy of Registration data (see our Privacy Policy), we will not monitor, edit, or disclose the contents of a customer's email unless (a) you authorise us to do so, (b) we must do so in order to resolve technical problems on our site; or (c) unless required to do so by law or in the good-faith belief that such action is necessary to: (1) comply with the law or comply with legal process served on us; (2) protect and defend our rights or property; or (3) act in an emergency to protect the safety of our customers or the public. Customers shall remain solely responsible for the content of their messages.

Happy Software, its subsidiaries and affiliates, and its licensors make no express warranties and disclaim all implied warranties regarding the services, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Without limiting the generality of the foregoing, Happy Software, its subsidiaries and affiliates, and its licensors do not represent or warrant to you that: (a) your use of the Services will meet your requirements, (b) your use of the Services will be uninterrupted, timely, secure or free from error, and (c) data and information provided through the Services will be accurate.

13. Limitation of Liability

You expressly understand and agree that Happy Software, its subsidiaries and affiliates, and its licensors shall not be liable to you for any indirect, incidental, special consequential or exemplary damages which may be incurred by you, however caused and under any theory of liability. This shall include, but not be limited to, any loss of profit (whether incurred directly or indirectly), any loss of goodwill or business reputation, any loss of data suffered, cost of procurement of substitute goods or services, or other intangible loss. These limitations Shall apply notwithstanding the failure of essential purpose of any limited remedy.

The limitations on Happy Software liability to you in this section shall apply whether or not Happy Software has been advised of or should have been aware of the possibility of any such losses arising.

Some states and jurisdictions may not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you. In no event shall Happy Software total liability to you for all damages, losses, and causes of action (whether in contract, tort (including negligence), or otherwise) exceed the amount that you have actually paid for the services in the past twelve months, or one hundred dollars ($100.00), whichever is greater.

14. Disputes; Choice of Law; Jurisdiction and Venue

You agree that any disputes arising out of or relating to this Agreement or the Service shall be resolved in accordance with this Section.

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without giving effect to any principles of conflicts of law. You agree that any action at law or in equity arising out of or relating to these terms shall be filed only in the courts located in Dubai, United Arabi Emirates and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action. If any provision of these terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these terms and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between us relating to the subject matter herein and shall not be modified except in writing, signed by both parties.
